Acceptable Use Policy

1. Purpose & Scope

This Acceptable Use Policy (“AUP” or “Policy”) governs the use of all services, systems, infrastructure, and platforms provided by Chance The IT Guy (“Company,” “we,” “us,” or “our”), including but not limited to web hosting, cloud services, managed IT, colocation, domain registration, and related products (collectively, the “Services”).

This Policy applies to:

  • All registered customers and account holders
  • End users authorized by customers to access Services
  • Third parties accessing Company systems on behalf of a customer
  • Employees, contractors, and agents of Chance The IT Guy.

By accessing or using any Service, you acknowledge that you have read, understood, and agree to comply with this Policy and all incorporated documents, including the Terms of Service and Privacy Policy. Failure to comply may result in suspension or termination of your account.

2. Permitted Use

You may use the Services only for lawful purposes and in accordance with this Policy. Permitted uses include:

  • Hosting lawful websites, applications, and digital content
  • Operating legitimate e-commerce, SaaS, or business platforms
  • Storing, transmitting, and processing data in compliance with applicable law
  • Developing and testing software applications in designated environments
  • Using IT infrastructure and managed services for authorized business operations

All use must comply with applicable local, state, national, and international laws and regulations.

3. Prohibited Use

The following activities are strictly prohibited on or through the Services:

3.1  Illegal & Harmful Content

  • Hosting, distributing, or transmitting any content that is illegal under applicable law
  • Publishing or linking to child sexual abuse material (CSAM) or any content that exploits minors
  • Facilitating or promoting terrorism, hate crimes, or incitement to violence
  • Infringing upon intellectual property rights, including copyrights, trademarks, and patents
  • Violating any individual’s right to privacy or engaging in unauthorized surveillance

3.2  Network & System Abuse

  • Launching denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
  • Attempting unauthorized access to systems, networks, or accounts (hacking)
  • Introducing malware, ransomware, viruses, trojans, or other malicious code
  • Port scanning or probing networks without explicit written authorization
  • Exploiting vulnerabilities in software, hardware, or network infrastructure
  • Circumventing access controls, firewalls, or security mechanisms

3.3  Email & Communication Abuse

  • Sending unsolicited bulk email (spam) or engaging in phishing campaigns
  • Operating open mail relays or proxies to facilitate spam
  • Harvesting or collecting email addresses without consent
  • Impersonating any person, organization, or entity in communications
  • Conducting SMS or email bombing or harassment campaigns

3.4  Resource Misuse

  • Mining cryptocurrency without prior written approval from the Company
  • Consuming excessive bandwidth, CPU, memory, or storage that disrupts shared infrastructure
  • Running unauthorized scripts or background processes that degrade service performance
  • Reselling or sublicensing Services without prior written authorization

3.5  Fraudulent & Deceptive Activities

  • Using the Services to conduct fraud, money laundering, or financial scams
  • Creating fake identities or falsifying account registration information
  • Operating phishing sites, counterfeit storefronts, or fraudulent donation platforms
  • Conducting pyramid schemes, Ponzi schemes, or other deceptive business practices

4. Security Obligations

Customers are responsible for maintaining the security of their accounts and hosted environments. Specifically, you must:

  • Use strong, unique passwords and enable multi-factor authentication (MFA) where available
  • Promptly notify us at hi@chancethetiguy.com of any known or suspected security incidents
  • Keep all software, CMS platforms, plugins, and dependencies up to date with security patches
  • Implement appropriate access controls to restrict unauthorized account access
  • Not share account credentials with unauthorized third parties
  • Conduct any authorized penetration testing only after submitting a written testing request and receiving approval

Chance The IT Guy reserves the right to suspend accounts that pose an active security risk to our infrastructure or other customers, without prior notice.

5. Content Standards

All content hosted on or transmitted through our Services must comply with the following standards:

5.1  Required Standards

  • Content must comply with all applicable laws in the jurisdictions where it is accessed
  • Adult content is only permitted on accounts where age verification has been enabled and confirmed in writing with the Company
  • Content involving real individuals must respect applicable privacy, defamation, and right-of-publicity laws

5.2  Prohibited Content

  • Child sexual abuse material (CSAM) or any sexualized content involving minors
  • Content that promotes, glorifies, or facilitates violence or self-harm
  • Material that constitutes illegal harassment, stalking, or threats
  • Counterfeit goods listings or trademark-infringing storefronts
  • Malware, exploit kits, or other malicious software

Chance The IT Guy retains the right — but not the obligation — to monitor hosted content. We will act on credible reports of policy violations, including by removing content or suspending accounts.

6. Data & Privacy Compliance

Customers who process personal data through our Services are responsible for ensuring their own compliance with applicable privacy and data protection laws, which may include:

  • The General Data Protection Regulation (GDPR) — European Union
  • The California Consumer Privacy Act (CCPA) / CPRA — California
  • The Health Insurance Portability and Accountability Act (HIPAA) — where applicable
  • Other regional or sector-specific data protection regulations

You must not use the Services to collect, store, or process sensitive personal data (e.g., health records, financial data, children’s data) without appropriate legal basis, consent mechanisms, and security controls. Chance The IT Guy acts as a data processor only; customers remain the data controller for their hosted data.

7. Enforcement & Consequences

Violations of this Policy may result in one or more of the following actions, at the Company’s sole discretion:

Where violations pose an imminent risk to other customers, our infrastructure, or third parties, the Company may take immediate suspension action without prior notice. We will endeavor to provide notice as soon as reasonably practicable thereafter.

8. Reporting Violations

If you become aware of any activity that violates this Policy, you are encouraged to report it. All reports are treated confidentially.

Chance The IT Guy will acknowledge abuse reports within 24 hours and investigate in accordance with our internal Incident Response Policy. We are not obligated to disclose the outcome of any investigation.

9. DMCA & Intellectual Property

Chance The IT Guy complies with the Digital Millennium Copyright Act (DMCA). If you believe that content hosted on our platform infringes your copyright, please submit a valid DMCA takedown notice to hi@chancetheitguy.com including:

  • Your full legal name and contact information
  • A description of the copyrighted work you believe has been infringed
  • The specific URL(s) of the infringing material
  • A statement of good faith belief that the use is unauthorized
  • A statement of accuracy and authorization, signed under penalty of perjury

Counter-notices may be submitted in accordance with 17 U.S.C. § 512(g). Repeat infringers’ accounts will be terminated.

10. Policy Amendments & Contact

Chance The IT Guy reserves the right to update, modify, or replace this Policy at any time. Material changes will be communicated via:

  • Email notification to the primary account holder
  • Prominent notice posted on our website
  • In-portal notifications for logged-in customers

Continued use of the Services following notice of any changes constitutes your acceptance of the revised Policy. If you do not agree to a material change, you may terminate your account prior to the effective date.
